1. Introduction
These terms of use govern the use of the domilinko platform, a marketplace for renting properties — short-term (a stay booked for specific dates) as well as long-term (a lease) — between individuals, owners and real-estate agencies, published and operated by Espero-Soft Informatiques SRL (Numéro d'entreprise (BCE) 1033.022.383), with registered office at Rue de la Colonne 1A, 1080 Molenbeek-Saint-Jean, Belgium. By using the Platform, you accept these terms. The detailed commercial conditions (role as intermediary, commission charged on short-term stays, owner subscription, application fee, ranking, liability) are set out in the General Terms of Use and Sale, available on the Platform.
2. Definitions
"Platform" refers to the domilinko website and application. "User" refers to any natural or legal person using the Platform, in particular the tenant who books a short-term stay or submits an application with a view to a lease. "Owner" refers to the owner or manager of a property (individual or real-estate agency) who lists it for rent via the Platform. "Platform Services" refers to the search for, booking of, application to, and connection between tenants and owners, as well as the management tools offered to owners.
3. Services
domilinko is an online marketplace that connects tenants with owners offering properties for rent, whether individuals or real-estate agencies. The Publisher acts solely as an intermediary and technical provider and is not a party to the rental contract — short-term stay or lease — concluded between the tenant and the owner; it does not guarantee the services, prices or availability of the properties.
Registration and search on the Platform are free. For short-term rentals, domilinko is remunerated through a commission charged on each stay; the payment made by the tenant is remitted to the owner, net of this commission, via the payment provider Stripe. For long-term rentals, the Platform collects no rent whatsoever: only the subscription of the owner or agency and, where applicable, the fee for the optional reusable-file service freely taken out by the tenant pass through Stripe; submitting an application is free. 4. Rules of conduct and User-generated content
Zero tolerance. domilinko enforces a zero-tolerance policy towards objectionable content and abusive behaviour. The following are prohibited: insulting, hateful, discriminatory, threatening or harassing remarks; sexual, violent or unlawful content; impersonation; spam, fraud and any attempted scam; misleading listings.
Responsibility for content. Users remain responsible for the content they publish (listings, photos, descriptions, reviews, messages) and warrant that they hold the necessary rights. The Platform automatically filters manifestly abusive content at the time of publication.
Reporting. Any User may report objectionable content or abusive behaviour directly from the Platform and the mobile app (« Report » button), or at signalement@domilinko.com. domilinko reviews every report within 24 hours, removes content that breaches these terms and, where appropriate, bans its author.
Blocking. Any User may block another User from the Platform and the mobile app. Blocking immediately and reciprocally hides both parties' content and prevents any new booking or application between them.
Sanctions. Breaching these rules may result, without notice, in removal of the content, suspension of the account or its permanent deletion, without prejudice to any legal proceedings.
5. Prices and payment
Searching the Platform is free. For short-term rentals, the price of the stay is set by the owner and displayed on the property's listing; domilinko charges a commission of 15% on each stay and remits the balance to the owner. A security deposit may be requested by the owner in the form of a card hold, according to the terms indicated before the booking. For long-term rentals, the Platform collects neither the rent, nor the charges, nor the rental guarantee — the latter is constituted outside the Platform, in the forms provided for by law: only the subscription of the owner or agency and, where applicable, the fee for the optional reusable-file service freely taken out by the tenant are paid on the Platform; submitting an application is free. Payments are processed securely via Stripe. Amounts are indicated in euros, all taxes included unless otherwise stated. The full terms are set out in the General Terms of Use and Sale.
6. Right of withdrawal
In accordance with Book VI of the Code of Economic Law, the consumer has a right of withdrawal of 14 calendar days. However, this right no longer applies once the execution of the service has begun with the express consent of the user. Short-term bookings for specific dates additionally fall under the legal exception applicable to the provision of accommodation for a specific period of performance.
7. Liability
domilinko commits to an obligation of means. We strive to provide accurate and up-to-date information but cannot be held liable for errors or omissions. The user remains responsible for the accuracy of the information provided.
domilinko shall not be liable for indirect damages, including loss of profit, revenue or data.
In its capacity as an intermediary, the Publisher is not responsible for the services provided by the owners, the condition of the properties offered, nor for the content published by the owners or the tenants. Reviews must be fair and reflect a genuine experience; fake reviews are prohibited.
8. Intellectual property
All content on the Platform (texts, images, logos, software) is protected by intellectual property rights and is the property of domilinko. Reproduction or distribution without prior authorization is prohibited.
9. Personal data protection
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these terms and is available on the Platform.
Account deletion. You may delete your account and personal data at any time, without contacting customer service: on the website, from Settings → Communications & personal data; in the mobile app, from Account → Delete my account (GDPR Art. 17).
10. Applicable law and disputes
These terms are governed by Belgian law. Failing an amicable resolution, any dispute falls under the exclusive jurisdiction of the Belgian courts.
